'Making a Murderer' defendant files latest appeal for new trial

MADISON, Wis. (WLUK) – Steven Avery’s attorney filed his latest appeal Monday, a 150-page document seeking to overturn his conviction for the 2005 murder of Teresa Halbach, which was explored in the Netflix series "Making a Murderer."

The appeal asked for a review of decisions by Sheboygan County Judge Angela Sutkiewicz, denying Avery new trials.

In it, Avery argues 10 issues, including: that additional scientific testing should be allowed, that Judge Sutkiewicz erred in denying a new trial on due process claims, that the circuit court erred by not properly addressing a claim of ineffective assistance of trial counsel, and that the judge erred by denying a motion without a reply from the state or a hearing

“For the reasons stated herein, Steven Avery respectfully requests that this Court grant him one of the following alternative remedies: 1) reverse the Orders Denying Postconviction Relief and remand for the State to file a response to the Motion for Postconviction Relief, and/or grant an evidentiary hearing; 2) reverse the judgments of conviction and the orders denying Postconviction Relief and remand for a new trial,” wrote attorney Kathleen Zellner.

The next step will be for the state to file a response to the motions.

No hearings have been scheduled.

Avery’s nephew, Brendan Dassey, was also convicted. His appeals have all be denied. He recently asked Gov. Tony Evers for a pardon, but that has not been ruled on.
